Equally, however, it would be a mistake to construe this caveat as grounds for dismissing distributional phenomena as having no relevance to conversation analysis. A distributional regularity across a class of interactions poses the problem of how that regularity is produced. In some cases, of course, it may be merely accidental and of no further interest, but in others it may direct attention to locally organized phenomena that otherwise might go unnoticed. The reproduction of social structure One of the underlying notions in the preceding discussion is that of a class of interactions that can be treated as homogeneous in some important respects.
In social research, this qualification is seldom recognized, much less satisfied. The concept of reflexivity as mutual constitution is Garfinkel's (1967); see also Maynard and Wilson (1980), Wilson and Zimmerman (1980), and Wilson (1982). Giddens (1976, 1984), clearly influenced by Garfinkel on this point, refers to it as the "duality" of social structure, while reserving the term "reflexive" to mean self-reflective. Note that Heritage (1984a) uses "reflexive" in each of these senses, depending on the context: specifically, he follows Garfinkel's usage when referring to accounts and Giddens's when referring to Parsons's conception of the actor.
Beginning in line 5 with "this is just a shoplifting case," the public defender offers a reformulation of the original burglary charge, employing devices generally found in disagreement sequences (Pomerantz 1984a): note the "just" in line 5 followed by an acknowledgment of certain facts in line 6, and the contrast foreshadowed by the use of "did enter" rather than simply "entered" in line 6 and made explicit with "but" in line 7. Moreover, in the next turn, line 8, the judge does not reject the public defender's talk as irrelevant to the proceeding but instead solicits a possible difference of opinion by the district attorney; and in line 9 the district attorney indicates there is none, thereby also acknowledging the intelligibility of a possible difference.
